What is workers' compensation and how does it work?

Workers' compensation covers medical costs and lost wages for work-related injury or illness. Coverage requirements and rates are set state by state.

What the coverage provides

Medical treatment for the work-related condition, partial wage replacement during recovery, rehabilitation support, and death benefits for dependents. In exchange, the system generally limits the employee's ability to sue the employer for the injury.

How cost is determined

Premiums are driven by payroll, job classification codes, and your experience modification rate — a factor reflecting your claims history against the average for your class of work.

Where an EOR changes the picture

When workers are employed through an Employer of Record, the EOR carries the coverage, manages the claims process, and absorbs the experience rating for that population.
